Terms of Service

These Terms of Service ("Terms") govern your use of the TradieLead service operated by COSAM Pty Ltd (ABN pending), trading as TradieLead ("we", "us", "our"). By subscribing to or using TradieLead, you agree to be bound by these Terms.

1. The Service

TradieLead is a missed call SMS automation service for Australian trade professionals ("tradies"). When a call to your TradieLead number goes unanswered, the caller hears a personalised voicemail greeting and receives an automatic SMS on your behalf. Caller replies are classified and forwarded to you as qualified leads.

The service includes:

• A dedicated Australian phone number for call forwarding
• Automated voicemail greeting with press-1 spam filtering
• Auto-reply SMS messages to missed callers
• AI-powered lead classification (issue type, urgency, location)
• A lead dashboard to view and manage your leads

2. Eligibility

To use TradieLead, you must:

• Be at least 18 years of age
• Be a resident of Australia or operate a business in Australia
• Have a valid Australian mobile phone number
• Provide accurate and truthful information during signup

3. Account Setup

After subscribing, you will be assigned a dedicated Australian phone number and sent a setup link via SMS. You are responsible for:

• Completing your profile setup (business name, trade type, SMS greetings)
• Configuring call forwarding on your mobile phone to your TradieLead number
• Keeping your account information accurate and up to date
• Maintaining the security of your setup and management links

4. Subscription and Pricing

• TradieLead subscriptions are billed monthly in Australian Dollars (AUD) plus GST where applicable
• All plans include a 7-day free trial. You will not be charged during the trial period
• After the trial, your payment method will be charged automatically each month
• Prices may change with 30 days' written notice to your registered email address

5. Plan Limits

• Starter plan: Up to 50 auto-reply SMS messages per calendar month. Once the limit is reached, missed calls are still logged but callers will not receive an auto-text until the next month
• Tradie Pro plan: Unlimited auto-reply SMS messages

We reserve the right to introduce fair-use limits on any plan to prevent abuse.

6. Cancellation

• You may cancel your subscription at any time through your account management page or by emailing us
• Upon cancellation, your service remains active until the end of your current billing period
• After your billing period ends, your dedicated phone number will be released and auto-replies will stop
• We do not offer refunds for partial billing periods, except during the free trial
• If you cancel during the free trial, you will not be charged

7. Acceptable Use

You agree not to use TradieLead to:

• Send spam, unsolicited marketing, or bulk messages
• Engage in any illegal, fraudulent, or deceptive conduct
• Harass, threaten, or abuse callers or any other person
• Impersonate another person or business
• Interfere with or disrupt the service or its infrastructure
• Use the service for any purpose other than legitimate trade business communications
• Resell or sublicense access to the service

We reserve the right to suspend or terminate your account immediately if you breach these terms, without refund.

8. SMS and Telecommunications Compliance

TradieLead operates in compliance with the Telecommunications Act 1997 (Cth), the Spam Act 2003 (Cth), and the Do Not Call Register Act 2006 (Cth). Our service:

• Only sends SMS messages to callers who actively opt in by pressing 1 or staying on the line
• Does not send unsolicited commercial messages
• Allows recipients to opt out by replying STOP

You are responsible for ensuring your custom SMS greetings comply with Australian law and do not contain misleading or deceptive content.

9. Your Data

Your use of TradieLead is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the service, you consent to the data practices described in that policy.

You retain ownership of your business information and lead data. We claim no ownership over the content of your SMS greetings or your customers' messages.

10. Intellectual Property

The TradieLead name, logo, website, application code, and all associated materials are the property of COSAM Pty Ltd. You may not copy, modify, distribute, or reverse-engineer any part of the service without our written permission.

11. Service Availability

• We aim to provide 99.9% uptime but do not guarantee uninterrupted service
• The service depends on third-party providers (Twilio, Stripe, Railway) and your mobile carrier's call forwarding capability
• We are not liable for missed calls, undelivered SMS messages, or service interruptions caused by third-party outages, carrier issues, or force majeure events
• We may perform maintenance with reasonable notice where possible

12. Limitation of Liability

To the maximum extent permitted by Australian law:

• TradieLead is provided "as is" without warranties of any kind, express or implied
• We do not guarantee that the service will result in any specific number of leads, jobs, or revenue
• Our total liability to you for any claim arising from your use of the service is limited to the fees you paid in the 3 months preceding the claim
• We are not liable for any indirect, incidental, special, or consequential damages, including lost profits or lost business opportunities

Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded by agreement.

13. Indemnification

You agree to indemnify and hold harmless COSAM Pty Ltd, its directors, employees, and agents from any claims, losses, or damages arising from:

• Your use of the service
• Your breach of these Terms
• The content of your custom SMS greetings or voicemail messages
• Any dispute between you and your customers

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to active subscribers at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising from these Terms or your use of the service will be subject to the exclusive jurisdiction of the courts of Victoria.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
